Overview
We are committed to respecting the privacy of users of SMCI’s web site and to this end are focused on providing a site which is safe and which promotes a satisfying user experience. In this privacy statement we will discuss our online data collection and usage policies and practices that apply to SMCI’s web site. Using our web site constitutes your implied consent to the policies and practices that we set forth here.
Any data that we collect via this web site will be stored and processed in the United States.
Our web site may contain links to other sites. We do not have control over such sites (except in the case of other SMCI® sites in which case the privacy statements contained on those sites will take precedence over this statement). We are not in any way responsible for the privacy policies or practices of these other non-SMCI® web sites you choose to link to from this site.
You should always (and we encourage you to) review the privacy statements of any web site that you use whether linked to or from an SMCI® site, or obtained in any other fashion, so that you will have an understanding of how those sites collect, use, and share your information.
This privacy statement applies solely to the information collected on this SMCI® web site. It does not apply to information SMCI® collects in any other manner.
Collection and Retention of Information
In some areas of our web site (e.g. our “Email Us”, “Submit Resume” and “Submit Referral” pages) SMCI® requests that you provide personal information. This information may include your name, address, email address, telephone number, other contact data, resumes, or other information that could be used to determine your identity.
In other areas of our site we may collect demographic information that is not unique to you such as your zip code, age, preferences, gender, interests and favorites, etc. In addition we may collect information relating to the nature of the employment you are seeking or might be interested in, such as specific companies you would like to work for or specific geographical areas or industries that you would like to work in.
Information that you provide to SMCI® is retained indefinitely by SMCI® in its candidate and requisition systems databases unless you request that we delete it. (However, in certain instances we may be required by law to retain candidate and employee information for specific periods of time; in these instances these legal requirements will take precedence over your requests that we remove your information.)
SMCI’s Use of the Information You Have Provided to Us
We use the information we collect on this SMCI® web site to conduct the recruitment activities of our organization in matching candidates to the job requirements of our clients and for the purpose of contacting you as described elsewhere in this statement. Feedback submitted via our web site is used to improve our operations as well as our web site.
Disclosure of Information to Others
It is SMCI’s policy to maintain the confidentiality of the information that you provide to us and we do not disclose your personal information to third parties except as detailed in the following four numbered paragraphs:
1. With your permission, after providing you with appropriate information and answering your questions we may disclose information about you to our clients, perspective clients, other consulting agencies, or other appropriate third parties in order to assist you with your job search.
2. We may disclose information about you to other business entities or to individuals that we employ or contract with to perform business related functions for us, or who provide business-related services to us, where such disclosure is necessary for these entities or individuals to carry out the functions or services that they are performing for us or providing to us. The information provided will only be that which is necessary for the entity or individual to perform the functions or render the services in question. In this instance such entities and individuals may not share the information with any other third party.
3. We may disclose information concerning you when legally required to do so, or where we have a good faith belief that we are legally required to do so.
4. We may disclose information about you in conjunction with the acquisition of all, part, or aspects of our business by another business entity whether through sale, merger, or consolidation of all or part of our business or as a result of our licensing the use of any or all of our business assets.
SMCI® may also share anonymous, aggregated and statistical information with clients or other third parties about the contents of its information databases when such aggregated information cannot be used to identify any of the specific individuals that the information relates to (e.g. how many candidates are contained in the database who know a particular programming language, or who reside in a particular city or state, or perform a particular job function, etc.)
Resumes Submitted to SMCI®
The most important information that you provide to us is the resume you submit to us so that we can assist you in your job search. When you submit your resume to SMCI® it is stored in our candidate database. Your resume and other information about you which is stored in our candidate database is only used by SMCI’s internal staff to assist you with your current and future job searches, and to keep you informed of employment opportunities which we believe may be of interest to you. SMCI® does not share your resume or other information concerning you with third parties without your express permission (except as detailed above). SMCI’s staff will always obtain your permission before submitting your resume or candidacy to a client or perspective client.
Security
SMCI® utilizes commercially appropriate and reasonable technical and organizational measures to secure your personal information from accidental loss and from access, use, alteration by, or disclosure to unauthorized third parties. However, it is impossible to guarantee that third parties will never be able to defeat the measures we employ and gain unauthorized access to your personal information. It is possible in the event of such unauthorized access that your information will be used for improper purposes. In the event of unauthorized access of information that is protected by law, we will provide you with notifications and take such other steps as are legally required under the circumstances.

In the event that we determine that it is necessary to change our privacy statement we will post those changes here so that you will always know what information we gather, how we might use that information, and to whom we will disclose it.
